MERCY MOUNTAIN

REFUGE LIABILITY WAIVER AND RELEASE

The undersigned guest(s) and licensees of Mercy Mountain Refuge hereby agree as follows:

I understand that I am a guest (also referred to as a licensee) of Mercy Mountain Refuge and have been given permission to use the guest home located at 401 Ponderosa Avenue, Estes Park, Colorado on the dates approved by administration. The guest home may also be referred to as the "premises" or "residence" in this agreement. Any reference to Mercy Mountain Refuge shall include its owner, managers, agents and contractors. The guest home is owned by Larry Strong and Sherie Strong.

Mercy Mountain Refuge has provided me with a copy of rules and regulations for the use of the guest house and I agree to be bound by all of the rules and regulations either given to me in writing or posted on the Mercy Mountain Refuge website. In addition, I hereby agree to the following:

1. I will only permit the persons below to occupy the residence during my stay at the guest home and agree that no minors under the age of 18 are permitted on the premises.

2. No pets will be allowed on the premises.

3. I understand that the premises are "smoke free" and will not smoke or allow any smoking or vaping on the premises.

4. I agree that although Colorado statute and law permits use of recreational and medical marijuana and cannabis, l will not allow any person to use marijuana, cannabis or any illegal drug or alcohol on the premises.

5. I understand and agree that the guest home is located in a community and I will observe the rights and quiet enjoyment of the residents of neighboring properties. I will not permit loud noises or music, disruptive behavior, disorderly conduct or any other action that would interfere with the quiet enjoyment of neighbors to the guest home.

6. I will not conduct or allow any action on the premises that violate any local, county, state or federal law.

7. I will keep the guest home in a clean and orderly condition.

8. I understand and agree that the owners or managers of the guest home may enter the residence in case of an emergency without notice.

9. The owners/managers of the guest home shall have the right to enter the residence with prior verbal notice if they determine that reasonable cause exists to verify that the rules and regulations are being followed.

10. LIABILITY/INDEMNIFICATION/WAIVER: In consideration of being a guest and licensee in the guest home, l agree to hold Mercy Mountain Refuge harmless and indemnified from all injury, loss, claim or damage to any person or property while on the premises, or arising in any way out of my use of the premises. Mercy Mountain Refuge shall not be liable for, and I waive all claims for, damage to person or property sustained by me, resulting from any accident or occurrence in or on the premises, including, but not limited to, claims for damage resulting from (i) any equipment, appliances, furniture or appurtenances being out of repair, (i) claims for, damage to person or property sustained by me, resulting from any accident or occurrence in or on the premises, including, but not limited to, claims for damage resulting from (i) any equipment, appliances, furniture or appurtenances being out of repair, (ii) Mercy Mountain Refuge, failure to keep the premises in repair, (iii) the bursting, leaking or running of any tank, tub, sink or other natural element, (iv) any defect in, or failure of, plumbing, heating or air-conditioning equipment, electric wiring, gas, water, stairs, porches, railings or walks, (v) broken glass, (vi) water, snow or ice being on the stairs, walks, driveway or elsewhere on the premises, (vii) fire or other casualty, and (viii) any hazardous materials or condition on the premises. The waiver and hold harmless agreement shall be binding upon my heirs, successors and assigns.

11. I understand that my failure in following any of the rules and regulations may result in termination of the invitation to use the guest home and result in immediate expulsion from the guest home.

12. I agree that this Agreement is governed by and construed in accordance with the laws of the State of Colorado. Venue is proper in Larimer County, Colorado. In the event of legal proceedings to enforce any term of this Agreement, the Court shall award the prevailing party its reasonable attorneys fees and costs.
